1. Acceptance of Terms
By accessing or using ScaleSMEs ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. The Service is operated by ScaleSMEs and is available at scalesmes.com.
2. Description of Service
ScaleSMEs provides AI-powered business automation — specialized AI agents that handle Sales, Marketing, and Customer Service tasks. The Service is delivered as a software-as-a-service (SaaS) subscription. Specific features and agent counts vary by plan tier.
3. Account Registration
You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You must notify us immediately of any unauthorized use.
4. Subscriptions and Payment
- Pricing: Solo plans are $19/month for 1 agent. Starter plans are $49/month for 3 agents. Growth plans are $79/month for every agent in your chosen department. Prices are in USD and subject to change with 30 days' notice.
- Free Trial: New accounts receive a 7-day free trial with full access. No credit card is required to start the trial. At the end of the trial, you must subscribe to a paid plan to continue using the Service.
- Billing: Subscriptions are billed monthly in advance. Payment is processed through Airwallex. You authorize us to charge your payment method on each renewal date.
- Cancellation: You may cancel your subscription at any time from your dashboard. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial months.
5. Acceptable Use
You agree not to:
- Use the Service for any illegal purpose or in violation of applicable laws.
- Attempt to reverse engineer, decompile, or extract the source code of the Service.
- Use the Service to generate spam, phishing content, or fraudulent communications.
- Exceed reasonable usage limits in a way that degrades the Service for other users.
- Resell or redistribute the Service without explicit written permission.
6. AI-Generated Output
ScaleSMEs uses large language models to generate content and recommendations. While we strive for accuracy:
- AI-generated output may contain errors or inaccuracies. You are responsible for reviewing and verifying output before acting on it.
- We do not guarantee specific business outcomes (lead conversion rates, revenue increases, etc.) from the use of the Service.
- You retain ownership of the data you provide and the outputs generated for your account.
7. Intellectual Property
ScaleSMEs and its original content, features, and functionality are owned by ScaleSMEs and are protected by international copyright, trademark, and other intellectual property laws. You may not copy, modify, or distribute any part of the Service without our written consent.
8. Limitation of Liability
To the maximum extent permitted by law, ScaleSMEs shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.
9. Service Availability
We strive to maintain high availability but do not guarantee uninterrupted access. We may schedule maintenance or experience outages. We will make reasonable efforts to notify you of planned downtime.
10. Termination
We reserve the right to suspend or terminate accounts that violate these Terms. Upon termination, your right to use the Service ceases immediately. You may export your data before termination by contacting hello@scalesmes.com.
11. Changes to Terms
We may modify these Terms at any time. Material changes will be communicated via email or through the dashboard at least 14 days before taking effect. Continued use after changes constitutes acceptance.
